TERMS AND CONDITIONS (“TERMS”) POLICY

Acting Classes in London

Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the www.betheactorwithin.com website and/or booking a class or programme operated by Be the Actor Within (“us”, “we”, or “our”). 
 Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others (“participant”) who access or use the website or our classes or programmes. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Reservations and Payment

To make a class, corporate or educational programme booking with Be the Actor Within participants need to make a booking enquiry. This can be done by emailing info@betheactorwithin.com or by telephoning 020 8242 4393. Be the Actor Within will reply to any booking enquiry within 24 hours.

Where a class, corporate or educational programme is available Be the Actor Within will provisionally reserve the space(s)/date(s) and will email the participant confirmation of this. The provisional reservation will be valid for 7 days unless otherwise stated and will only be confirmed once full payment for the space(s)/date(s) has been received. Be the Actor Within will send a separate email containing an invoice for the class or programme. The invoice will cover the cost of the class or programme plus any additional items requested by the participant or organisation (for example plays). Participants will need to pay the invoice in full using BACS transfer, cheque or cash. Where a participant is not able to use BACS transfer, cheque or cash, it is at the discretion of Be the Actor Within to determine if a class or programme can be confirmed and paid for at the start of the class or programme.

Be the Actor Within will email a booking confirmation to the participant or organisation within 24 hours of full payment being received. The booking confirmation email will confirm the class or programme (and any additional items) booked, date, start time, expected end time and location, Be the Actor Within facilitators contact details and what to bring to the class or programme. Please refer to our Cancellations and Refunds Terms should an amendment to a booking be required.

The prices on our website and promotional leaflets are correct at time of publication, however, we reserve the right to raise or lower our prices at any time. Be the Actor Within reserve the right not to accept or fulfil a booking request and all booking requests are subject to availability.

When a reservation is made by one person on behalf of another person or other people, the person making the reservation confirms to us that he or she has the authority to make such a booking on behalf of the other person(s).

Gift Vouchers

Be the Actor Within gift vouchers can be purchased for any value, single or multiple classes or with additional items including books and t-shirts.

Gift vouchers are valid for 12 months from the date of purchase. We regret that gift vouchers cannot be refunded, nor can they be exchanged for cash. Where a proportion of a gift voucher value has been used by the recipient we will issue the recipient a new voucher for the remaining value. This will be valid for 12 months from the original date of purchase.

Gift vouchers enquiries can be made by emailing info@betheactorwithin.com, by completing our Booking Enquiry Form online at www.betheactorwithin.com or by telephoning 020 8242 4393. Be the Actor Within will reply to any gift voucher enquiry within 24 hours.

Be the Actor Within will email the buyer to both confirm the value and to note any personalisation requests for the e-gift voucher. The buyer will need to state if they wish the e-gift voucher to be sent to them or direct to the recipient along with a personalised message. Be the Actor Within will send a separate email containing an invoice for the gift voucher. The buyer will need to pay the invoice in full using BACS transfer, cheque or cash.

Be the Actor Within will email the e-gift voucher to the requested recipient within 24 hours of full payment being received.

Gift vouchers can be redeemed by contacting Be the Actor Within quoting their unique e-gift voucher number. Participants should refer to the Reservations and Payment Terms for information on how to book a class or programme, and ensure they include their unique e-gift voucher number in any communication. Be the Actor Within will reply to their booking request within 24 hours and follow the stated Reservations and Payments Terms process with the exception of any email invoicing unless the e-gift voucher only part covers a booking.

Class or Programme Itineraries

Be the Actor Within reserves the right to vary a class or programme and thus exclude listed exercises, techniques and itineraries as deemed appropriate.

Be the Actor Within may, on very rare occasions, shorten a class or programme and thus exclude listed exercises, techniques and itineraries, if a participant or number of participants are deemed inadequately prepared to complete the class or programme, exercise or technique.

No refunds will be offered for any amended class or programme itineraries.

Under 18’s Policy

Minors aged 16-17 years old may, on occasion, be authorised to participate in the classes and programmes provided they are accompanied at all times by an adult. Any under 18 participant joining a class or programme must be agreed in writing in advance of the class or programme by Be the Actor Within. It is at the discretion of Be the Actor Within to determine if an under 18 is suitable to participate in the class or programme, and any decision made by Be the Actor Within must be respected and adhered to.

Our Be the Actor Within Educational Programme is available for children aged 11 years or above.  Children must be accompanied by an adult at all times during the sessions.

Cancellations and Refunds

We understand that it is not always possible to make a scheduled booking for a class. To cancel or amend a booking please email info@betheactorwithin.com. Provided that 24 hours’ notice is given before the scheduled start time of a class Be the Actor Within will provide an an alternative date, within that same term, dependent on participant preference.

Be the Actor Within are unable to refund participants who do not show for a class, and as our classes start promptly, we are unable to offer a refund to any participant who arrives late for a class.

Be the Actor Within are not able to refund any corporate or education programme cancellations where less than 7 days notice is given before the scheduled start date of a programme. Where possible we will offer an alternative date or time to reschedule the original programme.

Be the Actor Within reserves the right to cancel a class or programme for any reason. In the unlikely event Be the Actor Within cancels a scheduled class or programme, participants will be informed via their contact email address and an attempt will also be made to contact participants via their contact phone number. In such an occasion a full refund will be given via the original payment method for a programme and an additional class date offered for class.

Participant Responsibility and Health

Be the Actor Within is unable to provide any secure storage areas at our venues. Participants are advised to bring only essential items and are responsible for any items they bring with them into the class or programme.  It may be possible to store small items in the venue but participants do so at their own risk of loss, theft or damage. Be the Actor Within are not liable for any loss, theft or damage caused to a participant’s belongings before, during or after a class or programme.

Participants are also responsible for their own safety throughout the class or programme and are expected to exercise due care and attention at all times throughout the class or programme. Be the Actor Within is not liable for any injury, accident or even death caused to a participant during a class or programme.

Participants are responsible for ensuring they are dressed appropriately for classes and programmes, including wearing footwear suitable for these activities.

Participants acknowledge that taking part in a class or programme with Be the Actor Within can be physically strenuous. If you have a known medical condition or feel unwell it is your responsibility to declare this in full prior to the start of the class or programme, where appropriate, to bring a medical certificate authorising participation in the class or programme. Be the Actor Within reserve the right to refuse to allow a participant to take part in our class or programme based on the medical declaration.

Participants accept that taking part in classes or programmes that involve movement and physical exercises carry the risk of causing injury, both minor and potentially major or even death, and that they participate at their own risk. Be the Actor Within is not liable for any injury, accident or even death caused to a participant before, during or after a class or programme. Participants agree to sign a Release of Liability form at the start of each class or programme to confirm that they have voluntarily enrolled to partake in a class or programme and that they waive, release and forever discharge Be the Actor Within from any and all responsibility or liability for injuries or damages resulting from participation in our class or programme.

Class or Programme Photographs

Be the Actor Within may take photographs of participants and the class or programme. Participants authorise any photographs taken of them during the class or programme by Be the Actor Within to be used wholly or in part in any publication (commercial or otherwise), portfolio, promotional collateral, website, social media or public display. Participants who do not wish for their photographs to be used for this purpose will need to declare so in their Release of Liability form signed at the start of each class or programme. These photographs are copyright to Be the Actor Within. Use of the photographs may be granted to third parties, however the photographs will remain the property of Be the Actor Within.

Participant Behaviour

Be the Actor Within reserves the right to refuse a participant to take part in a class or programme, at the start of, or at any time during the class or programme, should the participant’s behaviour be deemed to be offensive to other participants. Be the Actor Within also reserves the right to stop a participant joining a class or programme if we feel their behaviour may put the safety of other participants at risk.

Be the Actor Within request that mobile phones are turned off or placed into airplane mode for safety reasons. We reserve the right to stop a participant joining a class or programme, or to continue with a class or programme, if we feel that their use of a mobile phone is a nuisance to other class or programme participants or could place them in danger whilst using the device.

Our website may contain links to third-party web sites or services that are not owned or controlled by Be the Actor Within.

Be the Actor Within has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that Be the Actor Within shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or I connection with the use of or reliance on any such content, goods or services available through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
